How Much Is My Personal Injury Case Worth?

This question is relatively common by perspective clients that comes with a varied answer.  Still, it is an important question to ask your lawyer.  An experienced lawyer will be able to advise you on the types of recovery that are available to you for your claim.  For example, in personal injury cases, a victim is entitled to recover money damages for medical expenses, lost wages and pain and suffering.  In wrongful death cases, families of  a deceased person are able to recover damages for the loss of companionship and support of the decedent.

However, there are limitations on the value of some cases.  Two unfortunate circumstances where this occurs is limited insurance and medical negligence cases that are affected by caps on non-economic damages.  In the former, an injured person is limited in their recovery by the amount of available insurance.  In rarer cases, a individual’s recovery is limited by the amount of insurance that she has.  For example, if you are injured by an driver with minimum state required insurance and you do not have underinsured motorist coverage, you may not receive full compensation for your losses.  In the later circumstance, victims of substandard medical care are limited in their recovery of pain and suffering (non-economic) damages.  These limitations prevent full justice for clients.
